Employee Health and Safety
Employees Infected with Aids/Arc

The Public Health Services' Centers for Disease Control (CDC) state that "the kind of nonsexual person-to-person contact that generally occurs among workers and clients or consumers in the workplace does not pose a risk for transmission of AIDS." Therefore, HIV-infected employees of the Board of Education shall be permitted to continue working as long as they are able to maintain acceptable performance and do not pose a safety or health threat to themselves or others in the workplace.

Where performance or safety problems arise, existing federal and state statutes, board policies, regulations and bylaws governing employment, working conditions, dismissal, sick leave, termination of employment and related matters shall apply to HIV-infected employees on the same basis as for persons having other diseases or conditions which may incapacitate them for work, or otherwise affect job performance.

Employee's right to privacy must be respected and strict confidentiality must be maintained. Documentation and other information relating to an employee's medical condition may be made available only to personnel having a direct need to know for an appropriate management purpose. All personnel having access to such information shall maintain the confidentiality of that information.
