Leaves of Absence
Workers’ Compensation Injury Leave
Regulation # 4620.9
Each employee suffering a personal injury for which he/she is entitled to benefits under Missouri’s Workers’ Compensation Law, shall be allowed a leave of absence, up to twelve (12) weeks in length (to run concurrent with any FMLA leave pursuant to Policy ____), during any period of Temporary Total Disability as defined by Missouri Workers’ Compensation Law. After twelve (12) weeks of concurrent FMLA/ Temporary Total Disability leave, the District may, in its discretion, grant employees additional leave time, which will generally not exceed one (1) year length. In accordance with Missouri Workers’ Compensation Law, employees will be eligible to receive compensation during any period of Temporary Total Disability.
Previously accumulated sick leave may not be used for any such absence, except that an employee may use accrued sick leave or PTO for the waiting period described in Mo. Rev. Stat. Section 287.160(1) so long as the period of disability lasted fourteen (14) days or less.
In the event that an employee receives sick leave for an absence which is later determined to be during a period of Temporary Total Disability under Missouri’s Workers’ Compensation Law, the employee will be required to reimburse the District for any sick leave pay received. The employee will be credited for any accumulated sick leave days or PTO days used during the period of Temporary Total Disability.
In no event shall an employee be entitled or allowed to receive both Temporary Total Disability Workers’ Compensation benefits and Sick Leave or PTO pay for the same absence as these forms of compensation are mutually exclusive.
