AWARD OF CONTRACTS

Bid and Award

All contracts for the erection of school buildings and all contracts for repairs and alterations or additions to existing buildings or materials, equipment, or apparatus to be furnished exceeding the sum of $5,000 shall be publicly bid.

The commissioner of buildings, with the assistance of the construction manager, shall prepare, or shall cause to be prepared, the necessary specifications and/or drawings, and solicit bids by advertisement.

No bid will be entertained that is not made in accordance with the specifications and drawings furnished. All bids will be deemed final, conclusive, and irrevocable and no bid shall be subject to correction or amendment for any error or miscalculation. No bid shall be withdrawn following the opening of bids, without the express permission of the board.

Bids on contracts for the erection of school buildings and contracts for repairs, alterations, or additions to school property shall be accompanied by bid security in the form of cash, cashier’s check, or a certified check, or bid bond as prescribed by the commissioner of buildings with the concurrence of the superintendent.

Unless otherwise specifically authorized by the board, the commissioner of buildings, with the concurrence of the superintendent, shall present a recommendation for award of the contract to the board. The board will award the contract to the lowest responsible bidder complying with the terms of the letting. The board shall have the right to reject any and all bids. Once approved by the board, unless otherwise specified in the resolution of approval, the board president shall execute the contract.

In the event a bidder is not awarded the contract, the bidder's bid security or bid bond shall be promptly returned. If a bidder is awarded a contract but fails or refuses to honor the award by executing the required written contract and providing any required documentation, the board may retain as its property any bid security, or may proceed against the surety on any bid bond.

Contracts involving the expenditure of less than $5,000 for work to be done and materials or equipment to be furnished may be made directly by the superintendent, or the commissioner of buildings without public letting and without advertising for bids.

In addition, the board may use its own employees to alter, maintain, and repair school buildings, to maintain and repair apparatus and equipment, or to make improvements to the school grounds without the letting of contracts whenever the total cost of labor on the job does not exceed $20,000.

All facilities contracts shall be drawn and executed on forms approved by counsel for the board.
